March 5, 2026 (Oakland, CA) — Despite an emergency request filed yesterday by the Sikh Coalition, Asian Law Caucus, and Weil, Gotshal & Manges LLP, the Superior Court of California, County of Alameda, declined to stop or postpone the cancellation of approximately 20,000 immigrant drivers’ commercial driver’s licenses (CDLs).
This ruling is a setback, because many drivers will face serious disruptions to their livelihoods starting tomorrow. However, there is still some relief from the Court’s previous ruling earlier this week. Important points for drivers to keep in mind:
Cancellations in Error: If the date on your CDL and employment authorization document (EAD) match OR if at the time you applied for your CDL, the expiration date of the EAD you presented was after the expiration date on your CDL, call the DMV at 916-306-5153 to request a review of your documents on file. Please make this call today before 5 PM. If that is not possible, please still call the DMV at your earliest convenience. If the DMV determines the cancellation was sent in error, it will issue you a correction notice; Punjabi media sources have reported drivers being successful in fixing wrongful cancellations in this way.
Checking Status: All drivers should check their status online with the DMV tomorrow. We have received reports that DMV has identified at least some wrongful cancellations and fixed them.
Cancellation of Mismatched Expiration Dates: If your CDL expiration date does not match EAD expiration date, your license will be cancelled today at 7 PM. If you cannot travel to the DMV today to downgrade, the DMV will provide an application process on their website and you will have to schedule an appointment with the DMV starting Monday, March 9. Through this process, you will be able to submit your application for a corrected CDL and you can receive your interim Class C driver’s license. The DMV has not yet provided a timeline of when they will begin to issue corrected CDLs. The Court has ordered them to do so within a “reasonable” amount of time.
Unfortunately, the Sikh Coalition is receiving multiple reports from drivers of individual DMV staff not following or knowing about these processes when they are called. For now, this is the best advice we can offer based on the information that we have. As we learn more from the DMV, we will continue to provide updates to the sangat.
