May 6, 2026 (Nationwide) — Amidst continuing federal and state efforts to target legal immigrants who hold commercial driver’s licenses (CDLs), the Sikh Coalition is writing to share recent important updates.
Major Federal Court Decision: Yesterday, the DC Circuit Court of Appeals declined to issue an emergency stay, or pause, of a harmful “final rule” (FR) previously put forth by the Federal Motor Carrier Safety Administration (FMCSA). The ruling came as a result of a lawsuit called Lujan v. FMCSA II, which challenged the federal government for attempting to push roughly 200,000 immigrants who are lawfully present in the United States and authorized to drive trucks and other commercial vehicles out of the workforce by prohibiting them from maintaining their CDLs. The Sikh Coalition and Asian Law Caucus submitted an amicus brief in support of this case in March, and we thank the Sikh organizations who joined us by signing on: the California Sikh Youth Alliance (CSYA), the Jakara Movement, SALDEF, and United Sikhs. The Court will hear full arguments in the case in September, and we continue to watch this case closely.
California Cancels Many Immigrants’ CDLs, but Renews Others: Last fall, under pressure from the federal government, the California Department of Motor Vehicles (CA-DMV) issued notices telling approximately 20,000 CDL holders that their licenses would be cancelled. Following a class action lawsuit by the Sikh Coalition, Asian Law Caucus, and additional partners, a California judge ordered the CA-DMV to provide a process for qualified drivers whose CDLs were cancelled in March to renew their CDLs and to issue those renewals in a timely manner. Additionally, some 7,000 cancellations have since been found by the CA-DMV to have been issued in error. We remain in close contact with our legal partners around potential additional efforts in California, and continue to share English and Punjabi language updates directly with as many truckers as possible. TAKE ACTION by Contacting Your Elected Officials in Congress: Elected officials in the House of Representatives are pushing forward a bill called “Dalilah’s Law” (H.R. 5688) They claim this law will stop “illegal aliens” from obtaining CDLs, but this is already against the law. What the proposed bill would actually do is implement the same ban on legal immigrants having CDLs as the FR mentioned above. The Sikh Coalition continues to engage congressional offices on this issue, including by recently briefing members of the Congressional Asian Pacific American Caucus.
More Work Ahead: Federal and state trucking policy across the nation continues to be increasingly hostile towards immigrant drivers. We continue to denounce the Trump Administration for their ugly efforts to smear all immigrant drivers as dangerous, but also prove with our California lawsuit that we seek to hold policymakers accountable for wrongdoing regardless of party affiliation. As we wait for the next arguments in the Lujan case, and as new bills and policy changes emerge, we will continue to keep the sangat informed and fight where we can have the greatest impact.
